Terms & Conditions


Payment Terms

Invoices are payable in full at time of delivery. Merchandise will not be left at the premises if payment is withheld for any reason. Customer agrees to withhold not more then 10% of invoice item total for items requiring service at time of delivery. Returned checks, for any reason, will incur a $30.00 processing fee. All outside funding must be received within 10 days after delivery. In the event customer can’t take delivery of items, all orders held over 10 days must be paid in full. All payments are due and payable in Dallas County, Texas. Customer agrees to pay late fee of 1.5% per month on all past due amounts, plus all reasonable attorneys’ fees incurred for collection.

Special Orders

Special orders are designated by an (*) before the item ID or (*) in the item description. All special orders require a 100% non‐refundable payment before order is placed with the vendor. Special orders are non‐cancelable and non‐refundable.

Storage Fees

May apply on any order held over 30 days. Any product left at Dallas Desk, Inc. over 180 days will be considered abandoned. All monies on such will be forfeited.

Used Furniture

All used furniture is sold as‐is. No holds, returns or refunds.

Lead Times

Lead Times for Stock and Special orders are based on average past shipping experience from our suppliers. Delays beyond the control of Dallas Desk may occur and as such expected delivery dates are only approximate. Dallas Desk cannot guarantee specific delivery dates and is not responsible for factory delays.

Returns

In‐stock and clearance (excluding used furniture) product may be returned within 5 working days of purchase. A refund will be issued pending inspection on the product only; delivery charges will be incurred unless a customer pick‐up (CPU). Any item not returned in original condition may be assessed a restock fee. Special order (*) items are non‐returnable or refundable. Requests for refunds will be processed within approximately 2‐3 business days for credit card purchases and 10 business days for check purchases and must be accompanied by proof of purchase.

Delivery & Installation

Our delivery personnel are responsible for installing only the furniture indicated on this contract. An additional fee will be charged to move existing property to complete the delivery. We will not move or disconnect any electronic media device including computers to facilitate delivery without the expressed written permission of the owner or authorized agent. Dallas Desk assumes no liability for damage [including software applications and networks] as a result of any action so authorized. Electrical work must be done by a licensed electrician. Unforeseen complications requiring non‐scheduled after hours delivery, elevator personnel, hoist or lift equipment will incur an additional charge. Dallas Desk personnel are not authorized to hang art, presentation boards, etc. This service is available for a nominal fee from independent installers. Rescheduled deliveries may be assessed a re‐delivery fee.

Delivery Times

Quoted times of day for deliveries are approximate only and are influenced by shipping delays, weather, and traffic conditions beyond our control. Dallas Desk assumes no liability for consequential damages for any reason. Delivery times that are restricted to specific time frames or Saturday’s will incur additional fees.

Independent Delivery & Installation Services

Dallas Desk assumes no liability for damages caused by service personnel not employed by Dallas Desk.

Customer Pick Up

Dallas Desk personnel will assist customers who wish to pick up their purchases. Dallas Desk assumes no liability for property damage or personal injury as a result of such action. Items must be returned to the dock for warranty work.

Inspection

Please inspect your new furniture purchases carefully. All defects and exceptions must be noted on the delivery receipt. Dallas Desk assumes no responsibility for merchandise after it leaves our premises or is signed for in good condition. Service work may be provided for an additional fee. Clearance & as‐is product may be touched up for a fee.

Warranty and Service Policy

Dallas Desk at its option will replace or service new merchandise for a period of one year from original purchase date if determined to be defective due to workmanship or materials. Proof of purchase is required. Dallas Desk will charge an hourly service fee plus parts to repair defects caused by excessive use, abuse, and incorrect care or cleaning. Damage from excessive temperature, humidity, or exposure to direct sunlight will result in a service fee as well. Fabrics, leathers, and vinyl coverings are not guaranteed against wear, fading, or inherent defects. Factory warranties beyond one year are subject to their own terms and conditions. Items returned to the factory for repair may incur freight and shipping fees. There is no warranty on glass tops. Please discontinue the use of damaged or defective product until repairs have been completed. Product picked up at Dallas Desk must be returned to our dock for warranty work. THERE ARE NO WARRANTIES THAT EXTEND BEYOND THE DESCRIPTION SET FORTH HEREIN.

Used, Closeout, Final Sale, As‐Is, Damaged items ARE SOLD ON AN ‘AS IS’, “WITH ALL FAULTS’ BASIS”, AND DALLAS DESK, INC. DISCLAIMS ANY IMPLIED WARRANTIES WITH RESPECT TO SUCH ITEMS.
